Philadelphia Orchestra emerges from bankruptcy

PHILADELPHIA (AP) ? The Philadelphia Orchestra is out of Chapter 11 bankruptcy.

A month after a U.S. Bankruptcy Court judge approved its reorganization plan, The Philadelphia Orchestra Association announced Tuesday it has officially emerged from Chapter 11.

The POA addressed more than $100 million in claims, debts and liabilities with a settlement of $5.49 million, a statement from the association and its subsidiary, the Academy of Music, said.

Of the total, $4.25 million will be paid according to an agreed-upon schedule, the statement said. The rest will be distributed according to a multi-year plan.

"We are deeply grateful to all who have championed and supported our Orchestra during this difficult yet necessary process," Allison Vulgamore, association president and CEO, said.

The orchestra stunned the arts community when it became the first major U.S. orchestra to file for Chapter 11 bankruptcy protection in April 2011.

Under the reorganization plan, the 111-year-old symphony will shrink from 105 musicians to 95 and cut their pay by about 15 percent. The orchestra also got a break on its rent from its main venue, the Kimmel Center.

Officials said the organization's long-term health has been bolstered by a new labor agreement covering musicians and a shift away from defined benefit pension plans.

Let?s start with the basics, what is umbrella insurance? A Umbrella Policy often called a PUP or Personal Umbrella Policy?provides an additional layer of protection above your home & auto insurance policy. A recent article in the Smart Money section of the Reading Eagle?with Bruce Williams went as far as calling it ?foolish? not to have this layer of coverage. The claimant sustained a spinal cord injury which rendered her an incomplete quadriplegic. She underwent surgery and was on a feeding tube for several months. She was able to return home 6 months after the incident, but continues to suffer partial paralysis of her arms & legs. She now uses an electric wheelchair to get around and requires assistance for daily living. The claimant owned her own business and was married one month before the incident. Her husband now cares for her at home. The settlement to the claimant exhausted the libaility limits on the insured?s homeowner?s insurance policy and payment was made under the personal umbrella.

Example #2: The client?s 18 year old son was driving the insured?s car on a short? trip to the store with his girlfriend, the claimant. The car left the road and struck a tree. The client?s son told the policy that a vehicle cut him off, but there were no witnesses and no evidence of any impact with another car. The claimant has no recollection of the accident. The claimant, a 19 year old college student was hospitalized for over a moneth with multiple fractures and internal injuries. She was in a wheelchair but is now able to walk with crutches and continues with physical therapy.? The insured?s personal umbrella policy limit was paid.

A British union has just called off a strike planned for Thursday by immigration staff at London's Heathrow Airport. Authorities had feared a walkout over pay and job losses would throw the Olympics into turmoil. Authorities this week urged the workers to consider the damage such action would inflict on Britain's image with the world watching.

Georgia's National Olympic Committee is fuming over two Russian athletes, born in what was then the Soviet Union's republic of Georgia, describing their place of birth as breakaway republics that Georgia and the international community do not recognize.

"Politics should not meddle in sports," says Georgiy Asanidze, a member of Georgia's Olympic Committee.

The games' official website lists Russian wrestler Besik Kudukhov's place of birth as "South Ossetia, Russia." The place of birth of another wrestler Denis Tsargush, born in the town of Gudauta, is also listed as Russia. Abkhazia and South Ossetia threw off most Georgian control in separatist wars in the 1990s, but Georgian authorities retained control of swaths of South Ossetia and a small piece of Abkhazia until the 2008 war with Russia. Afterward, Russia recognized their independence, as did Nicaragua, Venezuela and a handful of tiny Pacific nations.

Will he? Won't he? British newspapers have buzzed with speculation that Muhammad Ali may have a role in London's Olympic Opening Ceremony on Friday.

The 1960 heavyweight boxing gold medalist and former world champion is in town this week, but looks far too frail to play a significant part in director Danny Boyle's spectacular on Friday night.

At an award ceremony on Tuesday, Ali was helped onto stage and sat largely motionless. Parkinson's disease has stolen the 70-year-old's once-world-beating strength and quick reflexes and frozen his beautiful face into a mask. Ali did not speak at the ceremony.

Among those who hope Ali will make an appearance, however brief, at the Opening Ceremony is Tyrone Monaghan. His father, Paddy, a bare-knuckle boxer, struck up a long friendship with Ali when both were younger. On visits to Britain, Ali regularly would drop by the Monaghans' house ? to drink tea, chat and even spar with Tyrone.

"There are so many great things about him," Tyrone says of Ali. "You can't sum it up in one sentence."

ON THE ROAD AGAIN

Wednesday marks the first day that London's usually aggressive drivers have to respect the unpopular "Games Lanes" ? known informally as Zil lanes, after the Russian limos ? or face a stiff fine.

There were fears of massive tie-ups as two-lane motorways were effectively cut in half to make way for the "Olympic family" vehicles allowed to use the special lanes, so many commuters seem to have switched to public transport to avoid the hassle.

On the A40 highway into central London, rush hour traffic was lighter than usual, and the Zil lane was completely empty save for a few black BMWs and a couple of truck drivers who didn't seem to have got the message.

As the road spilled onto Marylebone Road near Madame Tussauds wax museum, a large electronic sign told motorists they were free to use the Games Lanes at that point, but few ventured over the imposing double-width, solid line painted on the roadway for the Olympics period ? despite the reassurances, they were apparently afraid that London's ubiquitous traffic cameras would cause them to be fined.

Eventually, as traffic slowed and a second sign said all lanes were open, drivers crossed the line and normal traffic patterns resumed.

Business Networking with a Passion

We have learned a lot of lessons on our trip into business and one of the greatest is the need for small to medium sized businesses to keep in touch and help each other out. Bounce ideas around and encourage and help each other as often as possible.

When I started this business I decided from the word go that I would go around as many of the networking group?s I could and see what format suited me best and what other companies were talking about and experiencing out there in the big bad world.

I found these a melting pot of different people with many different ideas and passions.

In fact what came across from many of the people and businesses I met and am still meeting is their passion for what they thought could be achieved. They weren?t just selling a business idea or telling me about their business they had a passion burning inside about it. That was something that I had so I could immediately relate to it.

Many things try and drive it out from you in the early days, such as banks, cash flow and people who are being friends, ?Well it?s not a good time to set up a business and we are in recession.?

If I heard that once I heard that a million times. When will be the right time?

I eventually found the type of networking that suited me and have stuck to it and attended even when I felt I did not want to. Each time I have come away with a sense of satisfaction and have met some brilliant people over the last few years.

With this all in mind, I wanted to gather all this passion together into one place and let it bounce of everyone in the room, think of it like a light show.

So a good friend and organisation I deal with have come in with me, Tim Thomson, Manager at The Vine Venue, Dunfermline, ?to create InVite Business Networking, we launched in June and had 19 businesses attend the opening event. We have held one in July and 14 businesses attended some new ones from the original event and we are holding the next one on the 16th August.

Out tag line is Get Involved?? and we truly believe we can change things, when small businesses get together with passion; we become the equivalent of a larger organisation without all the politics.

We are launching the InVite soapbox in September where each business who attends regularily will get 10 minutes to soapbox their business passion. We are having guest speakers and a once a year business showcase.

In my book, Extreme Weather, I interviewed veterinarians Dr. Charlotte Krugler and Dr. Adam Eichelberger from Clemson University in South Carolina. They offer terrific tips and answer questions on how to protect your pets from extreme heat. Here is an excerpt:

How do pets react in hot and humid conditions?

Dogs and cats often cool themselves by panting and also by sweating from their foot pads.

How do you know if it is too hot for your pet?

A pet owner should note how their pet normally breathes when lying quietly compared to light activity and vigorous exercise. Then theyll be more likely to notice abnormal clinical signs when a pet is too hot ? such as heavy panting when not exercising, open-mouth breathing, inactivity, lack of appetite, mental dullness, and diarrhea.

When temperatures get hot, pets should not be encouraged to undergo vigorous activity for prolonged periods. Vigorous activity on a hot day increases the chances of a pet overheating, so owners should be especially vigilant during these times. This means:

- Never leave a pet unattended in a car on a warm or hot day.
- Keep fresh water available ? cool when possible.
- Provide protection from direct sunlight; allow access to shade and shelter.
- Ensure that pets are not confined in areas without air flow on hot and humid days.

What should you do if you suspect your pet is overheated?

If pet overheating is suspected, the pet should be taken to a veterinarian immediately. In the interim, cool water (not warm, not cold) can be applied directly, or via dampened towels, to the pets foot pads, to areas under armpits, inside back legs, and underside of the belly to help lower the pets body temperature.

Can animals get sunburn?

Yes, animals can get sunburned (including dogs, cats, horses, pigs), so any bright day with direct exposure can result in a sunburn. Some animals seem to be more susceptible. Sunburned areas on white cats (usually ear tips) and pink-skinned areas on horses can progress to skin cancers.
Certain diets can induce photosensitivity, which will lead to sunburned skin in some animals.

Is heat tougher on certain breeds than others?

It seems that dog breeds with very thick, dense coats can have a tougher time in the heat. Some arctic breeds may be more suited to cooler climates. Also, black dogs are believed to absorb more heat into their bodies and seem to have problems on hot days, especially when exposed to direct sunlight. Very thick-coated dog breeds may benefit from being shaved down by an experienced pet groomer once or twice during the hot season.

What are common mistakes pet owners make in the warm-weather months?

The most serious mistake is to leave a pet in a closed automobile on a hot day. Leaving the windows open will not prevent the temperature of the car, and then of the pet, from rising.
Another common mistake is overexercising a dog on a hot day and not allowing the pet to cool down properly after a period of exercise. When dogs accompany owners on activities such as jogging, hiking, beach trips, etc., water should be provided at regular intervals and rest periods provided.

The latest unadulterated delight from Wes Anderson, director of "Rushmore," "The Royal Tenenbaums" and "Fantastic Mr. Fox."

The usual complaints and caveats about Anderson - he's precious, his characters have no grounding in the real world - can be made about Moonrise Kingdom, but so what?

Anderson and his actors are able to convey more genuine feeling through these devices than most filmmakers can with more-traditional means.

One knock against some of Anderson's previous efforts is that they're too clever - so clever, in fact, that the humanity gets sucked out of them. That doesn't happen here.

"Moonrise Kingdom" is the type of movie that is charming for the soul and makes your brain happy in the process. All in all, it's just a heartfelt and well-written experience that will appeal to everyone.

These charming kids give "Moonrise Kingdom" the warm glow of a summer fairy-tale, one you'll want to hear again.

Pure Joy. This film's heroes may be pint-sized but their emotions and dreams are larger than life.

My immediate response is that it's a masterpiece and the best film to come out so far this year.

The offbeat, pixilated universes created by writer/director Wes Anderson (Rushmore, The Royal Tenenbaums, Fantastic Mr. Fox) are an acquired taste.

It's hard to judge a movie as a movie when you want to live inside it.

Magical Moonrise a Romantic Delight.

Intermittently amusing, distinctive, not always easy to digest

Moonrise Kingdom left me thunderstruck. ... Anderson contrasts a world in disorder with a well-pitched campsite, where everything is in its right place.

Anderson's movies work best if they're about kids or cartoon animals.

Among the all-stars, Edward Norton made me repeatedly chuckle, and it's always a pleasure to see Bruce Willis when he's not operating in paycheck-whore mode.

A sweetly kooky ode to the intensity of young love. The movie balances broad comedy with occasionally surreal quirk, while still holding the emotional center.

The adults who are so desperate to return the kid fugitives to their care actually envy the children's freedom, irresponsibility and, yes, love -- in a word, their youth: The kingdom that makes exiles of us all.

The frustrating Anderson is improving, and he may one day shed the collegiate hipster aura that infuses his work.

The plot isn't as fetching as the presentation, starting with the tersely whimsical dialogue. There aren't punch lines for big laughs, but rather a seamless series of non sequiturs for smiles.

It's funny, it's touching, it's Anderson doing what he does better than he's ever done before.

Wonderfully inventive and entirely immersing.

The great thing about Wes Anderson, other than his fabulously childlike imagination, is his deep attention to the smallest details.

SHANGHAI (AP) ? China moved Monday toward its biggest overseas energy acquisition as offshore oil and gas giant CNOOC Ltd. announced an agreement to buy Canadian producer Nexen Inc. for $15.1 billion.

The deal faces scrutiny from the Canadian government, which has rejected foreign interest in the past over worries about the country's natural resources industry.

CNOOC and other big state-owned Chinese energy companies have increased purchases of oil and gas assets in the Americas as part of a global strategy to gain access to resources needed to fuel China's economy. The companies have moved more carefully since CNOOC tried seven years ago to buy Unocal but was rejected by U.S. lawmakers citing national security fears.

Total acquisitions by Chinese energy firms jumped from less than $2 billion between 2002 and 2003 to nearly $48 billion in 2009 and 2010, according to the International Energy Agency. More times than not, the companies are paying above the industry average to get those deals done.

Indeed, the offer of $27.50 a share is a premium of 60 percent to Nexen's closing price Friday on the New York Stock Exchange. Shares rose 52 percent in $25.95. CNOOC expects the takeover to be finalized in the fourth quarter of this year, pending government approvals.

Calgary, Alberta-based Nexen operates in western Canada, the Gulf of Mexico, North Sea, Africa and the Middle East, with its biggest reserves in Canadian oil sands. It produced an average of 213,000 barrels of oil equivalent a day in the second quarter of this year.

The acquisition vastly expands CNOOC's holdings in Canada, where the company has already invested about $2.8 billion.

Nexen has faced numerous challenges over the past few years, most recently the troubled launch of its Long Lake oilsands project in northern Alberta in late 2008. The project has yet to come close to its design capacity of 72,000 barrels of bitumen per day due to a number of operational glitches, though performance has been improving in recent months.

CNOOC already had a 35 percent stake in Long Lake after it took over Nexen's erstwhile partner Opti Canada Ltd.

That previous partnership with Nexen makes CNOOC the optimal buyer for the company, said Sam La Bell, an oil and gas analyst at Veritas Investment Research.

"CNOOC is the natural buyer," he said. "We view this as full value for the deal. CNOOC already owns a minority position in Long Lake so they're in the best position to know that asset and what they're paying for it."

The companies already also had a strategic alliance that involved CNOOC investments in Nexen offshore wells in the Gulf of Mexico. Nexen says it produced 22,000 barrels of oil equivalent per day in the Gulf in 2011.

Besides oil sands, Nexen is also active in exploring for natural gas in shale rock formations. It owns about 300,000 acres of shale-gas blocks in the Horn River Basin in British Columbia.

The big Chinese oil companies are interested in developing shale-gas technology to find new supplies in China. In the U.S., where companies have solved the technological challenge of extracting natural gas from shale, a boom in production has meant cheap natural gas for homeowners, businesses, factories and utilities in the U.S.

Canada said the takeover offer will face a review by both its industry minister and the Competition Bureau, an independent law enforcement agency.

Industry Minister Christian Paradis said in a statement that he will review how the deal affects investment, employment, production and resource processing in Canada. He said the Competition Bureau will determine if the deal substantially lessens Canada's ability to compete in global markets.

He did not give a timeline for the reviews.

It will be a tough call for the government, which has to decide whether the deal is a net benefit to Canada as a whole and not just to shareholders, said University of Calgary economist Jack Mintz.

"It's going to be hugely political," Mintz said. He said CNOOC prepared its bid with an eye to regulators by offering a 61 percent premium to shareholders and stressing that it intends to keep the Calgary-based management intact.

The last time Canada faced a similar challenge ? when Australia-based BHP Billiton Ltd. launched a hostile takeover bid for Saskatchewan's Potash Corp. ? the government rejected the deal under pressure from Saskatchewan Premier Brad Wall and corporate players. The Conservative government said the Potash takeover would not bring a net benefit to Canada.

But La Belle said he believes this deal will be approved because it meets the somewhat ambiguous guidelines of providing a 'net benefit' to Canada.

"With the net benefit test, you're looking at whether the asset is strategic for national interests, and it's hard to argue that this is for Canada, especially with the Long Lake project," he said.

He said the government will also look at whether jobs will be maintained in Canada and CNOOC said most, if not all jobs will be maintained, and that it will set up its regional headquarters in Calgary, increasing the company's spending to develop the Canadian company's energy reserves.

"They're not offering a lot more than stand-alone Nexen would have done, but they're also not taking much away, which factors into what the government takes into account in its approval process," said La Belle.

Wenran Jiang, a senior fellow at the Asia Pacific Foundation of Canada, said the Nexen deal is not the kind of surprise move that startled the U.S. with the Unocal takeover bid. "This one has been incremental and has been, of course, in an environment that's most likely to go through," Jiang said, noting that Beijing-Ottawa relations have been warming in recent years.

La Belle, who said the deal will also require U.S. approval, said he doesn't think this deal will instigate the same concern in the U.S. as Unocal did.

"It's a very different situation here because the Gulf assets that Nexen has in the U.S. are offshore, and they're minority interests for the most part, they don't operate them. There's no strategic infrastructure, Unocal had a bunch of onshore infrastructure and it was a U.S. company so the difference was selling a U.S. company directly to a Chinese buyer or selling assets that are already held by foreign companies. The assets that Nexen has are already outside of the U.S.," he said.

OAKLAND, Calif. (AP) - Brandon Moss hit a game-ending RBI single with one out in the ninth inning to give Oakland another dose of late-inning dramatics as the Athletics beat the New York Yankees 3-2 on Friday night for their seventh win in eight games.

Yoenis Cespedes singled with one out in the ninth off Cody Eppley (0-1) for his fourth hit of the game and went to second on Jonny Gomes' infield hit. Moss, who left the bases loaded twice earlier in the game, lined a single to right field and Cespedes slid in safely ahead of Andruw Jones' throw.

That gave Oakland its 10th walk-off win of the season and seventh in its past 14 home games, bailing out All-Star closer Ryan Cook, who allowed a game-tying homer to Robinson Cano in the top of the ninth.

Late Sunday afternoon, less than a mile from the White House, the U.S. will witness something that it has not seen in 22 years: the opening of an International AIDS Conference.

The meeting, which this year is expected to draw about 25,000 scientists, activists and celebrities, has been held abroad for two decades because in 1987 the U.S. Senate unanimously passed a measure preventing anyone with known HIV infection from entering the country. At the time, the gathering?launched in 1985, four years after the first recognition of cases in the U.S.?alternated every year between U.S. and foreign locations. The 1990 conference in San Francisco, the first held after the rule was finalized, was gravely disrupted by thousands of delegates who stayed away?so much so that Harvard University, set to be the next U.S. host, announced it would withdraw its sponsorship unless the ban was lifted. It was not. The 1992 conference moved instead to Amsterdam, and the annual meeting stayed away until President Barack Obama lifted the travel ban in late 2009.

So much changed in that 22-year span that the conference?s return effectively marks a truly new phase in the epidemic. The latest report from UNAIDS, the United Nations agency that monitors the global epidemic, backs up the sense that things are changing. The report, released Wednesday, found that among the 34.2 million people living with HIV, fewer are dying: There were 1.7 million deaths last year worldwide, compared to 1.8 million the year before and a peak of 2.3 million in 2005. At the same time, the report said, new infections are declining too, by almost 20 percent in the past 10 years.

Simultaneously, after many years of disappointments, research is returning hopeful results for both prevention and treatment. Three years ago, scientists reported the first promising findings in the search for an HIV vaccine, considered the key to global eradication. Two years ago, researchers published the first partially successful trials of both a microbicide and a drug cocktail that may prevent infection. Last year, a nine-country trial demonstrated that getting infected people into treatment very quickly can keep them from passing the disease along. And since 2007, scientists have been closely watching the "progress of the ?Berlin patient"?the only person, out of 60 million believed to have been infected in more than 30 years, who appears to have been cured of HIV.

The situation now is so different from 1990?when AIDS was a fast-moving, terrifying and invariably fatal disease, as captured in the new documentary How To Survive A Plague?that two HIV researchers writing in this week?s New England Journal of Medicine daringly titled their editorial: "The Beginning of the End of AIDS?"

For anyone who remembers HIV's apocalyptic arrival?I?m one of them, and lost many friends in the early days?the current moment feels as major a shift as 1996, when multi-drug cocktails came to market and people visibly on the verge of death recovered in ways that seemed miraculous. A friend quipped then that it was the first time in 15 years he could take his florist off speed-dial.

And yet: Major challenges remain, and in many ways the perception of AIDS as a chronic disease may make them harder to tackle.

Sheets extends streak, Braves beat Nationals 4-0

WASHINGTON (AP) ? Ben Sheets is giving the Atlanta Braves an unexpected lift in the pennant race.

Then again, it's not that surprising. The four-time All-Star has turned in stellar outings before.

Sheets pitched six shutout innings, Brian McCann and Chipper Jones homered and the Atlanta Braves beat the Washington Nationals 4-0 on Saturday in the opening game of a day-night doubleheader.

Washington removed Bryce Harper from the game after two innings with a left ankle bruise. The rookie outfielder was out of the starting lineup for the nightcap.

Outdueling Nationals starter Edwin Jackson (5-6), Sheets (2-0) extended his scoreless innings streak to 12 in his return after missing last season because of Tommy John surgery on his right elbow. The victory pushed the Braves' winning streak to three and moved them within 1? games of the NL East-leading Nationals.

"It's been a huge pickup for us," McCann said of adding Sheets to Braves rotation. "To come out here for his two starts and pitch the way he has. Hasn't given up a run, he's pounding the zone and the more you're around him the more you know why he's so successful. He's a competitor, he knows what he's doing."

The Nationals have lost three straight, including the series opener Friday night, blowing a 9-0 lead before falling 11-10 in 11 innings.

The 19-year-old Harper fouled a bunt off his left ankle. MRI exam revealed no break.

"(Bryce) was down hitting, trying to swing with it, and Michael Morse and LaRoche saw him and said he can't even swing. So, that's why I took him out," Johnson said.

McCann's solo homer in the second inning, his 16th of the season and seventh in his last 10 games, gave the Braves their first run. Atlanta added another in the eighth as Michael Bourn scored on a wild pitch by reliever Henry Rodriquez.

Jones, entering as a pinch-hitter in the ninth with a runner on, clobbered the first offering from Ryan Mattheus over the right field wall.

In his second start of the season and with light rain falling intermittently, Sheets threw 91 pitches, allowing five hits with six strikeouts and three walks.

"If you're asking me if I'm surprised I haven't given up a run, yeah," Sheets said. "I'm not surprised that I'm getting people out. I wouldn't have come back if I didn't think I could get anybody out."

The Nationals put runners on in five of the opening six innings. Three times, they had two men on base, but could not capitalize.

Sheets threw a fastball past Adam LaRoche, striking out the slugger with two on to end the first. With runners on the corners and one out in the third, he induced Michael Morse into a double-play grounder.

After allowing a single and one-out walk in the sixth, the 33-year-old nimbly recorded the final two outs, including another strikeout of LaRoche.

"I had a couple of chances to drive some guys in," said LaRoche, who denied any carryover factor from Friday's stunning loss. "(Morse) hits a ball on the screws into a double play. One of those nights, just didn't get enough going."

Washington finished 0 for 7 with runners in scoring position, all against Sheets. Kris Medlin and Chad Durbin combined for three scoreless innings of relief.

Jackson struck out nine to match his season high while allowing five hits and two walks over seven innings. His one mistake, McCann's homer as the high drive landed over the right-center wall. The Braves catcher has homered in three straight games.

"Once I found it, I knew," McCann said of his recent power surge and 11-game hitting streak. "I haven't felt like this since 2008, really."

Bourn finished with two of the Braves' nine hits and had two stolen bases. He swiped third as the front end of a double steal in the eighth inning before scoring on the wild pitch.

Harper's failed bunt attempt came in the bottom of the first inning. Limping and doubled over in pain for several moments, the first time All-Star completed the at-bat by striking out. Harper returned to center field in the second inning, but Roger Bernadina replaced him on defense for the top of the third with the Nationals trailing 1-0.

Bernadina had two hits and threw out Paul Janish attempting to move from first to third on Michael Bourn's one-out single in the fifth.

The opening game was a makeup for the June 1 rainout. Considering the Braves recent run, one might call the timing of the makeup fortuitous.

"Certainly last night's game you chalk up as a fluke because that doesn't happen very often," Jones said of the nine-run rally. "But to back it up with a solid performance today, now we get some momentum going. I can't think of a better day to have a doubleheader, as nice a roll as we're on."

NOTES: Braves second baseman Dan Uggla finished 0 for 4, all on strikeouts, three coming against Jackson. . With two RBIs, Jones has 1,600 for his career. ... Nationals OF Steve Lombardozzi and Braves 1B Freddie Freeman had their hitting streaks end at 13 and 11 games, respectively. ... The Braves recalled RHP Randall Delgado to start the nightcap of Saturday's doubleheader against John Lannan, making his 2012 debut.
