Mark Cuban?s name is always mentioned when a baseball team is up for sale. Yet he never seals the deal. ?It just happened with the Dodgers too. ?His?explanation:

?The economics got so out of control because the Dodgers? TV deal?s up for bid and so there?s a lot of groups coming in going, ?This TV deal?s worth so much money that we?re gonna pay whatever it takes to get the Dodgers.? And so they?re buying the TV rights deal first and the team second,? Mark said.

So what? ?All of these groups are helmed by billionaire investor types who know a thing or two about money. There?s, like, a dozen of them. ?Are they all irrational? Are they all irrational in thinking, contrary to Cuban?s implication here, that a bid on the Dodgers + the TV rights would make money?

I?m all for occupying whatever and sticking it to those billionaires, but when a bunch of them all think something is a good investment, they?re probably right. ?The fact a highly-lucrative?TV rights sale is in the offing, if anything,?seems like a lure to buying the team, not a deterrent as Cuban suggests.

Even something as exhaustively planned as the test-flight of the Orion spacecraft isn't immune to a slipping timeline. It's reportedly been pushed back from next year to 2014 -- when we're expecting to see the capsule launch from Cape Canaveral, loop around the planet twice at 3,700 miles (the furthest any spacecraft has journeyed since the '70s) before splashing down in the Pacific. This unmanned test was designed to see if the vehicle's heat-shield, flight-software and parachutes all work before lives are risked on board. It's also signified a pushing back of the first launch from 2016 until 2021. This means there's nine more years before someone calls us up as a crew replacement -- at least that's how our dream goes.

Obama as Much for Big Business as Republicans (ContributorNetwork)

COMMENTARY | Ener1 is the third "clean energy" company to file for bankruptcy after receiving stimulus money from President Barack Obama, according to Fox News. As a political scientist, I have always found it odd when people accuse Republicans for being the party for big business. President Obama and the Democrats are just as much for big business as Republicans. They just support different types of corporations.

The "clean energy" companies are a perfect example when you look at how President Obama tossed money at companies like Solyndra, EnerDel (part of Ener1) and Beacon Power. All three went bankrupt after blowing through taxpayer money. If Republicans gave handouts and loans like this to oil companies, the media would rip them apart.

Over the years, the Democrats have been successful in painting perceived reality in which many people believe Republicans only have the interests of big business in mind. Money and support given by the unions (which are a big business themselves) add to this perceived reality. President Obama constantly presses support for "clean energy" to divert more money to the type of corporations the Democrats have become the lapdogs of. This also pulls attention and money away from supporting the oil industry which supports the Republicans.

Since President Bill Clinton began actively supporting environmentalist companies, the market has exploded. Global warming, recycling, ozone holes and "clean energy" have led to a multibillion-dollar industry. Occasionally, requests for padded numbers or padded numbers of environmental studies have leaked in the media such as the accusations of ECSI or the hacked global warming emails. These reports are rarely covered by the mainstream media but still exist.

When President Obama makes statements about how he is for the people and is trying to fight the big corporations of the Republicans, think about the corporations which he supports. Think about how he supports an industry that is based on the fear of environmental backlash. Note how the scientists who support their theories of "clean energy" have to pad their numbers to look more important so they can get more of your money.

President Obama and the Democrats have pressed us on the need for "clean energy." This corporation has padded numbers and given their execs large bonuses with our money. Both parties are backed by large corporations. Don't give into the lie that one party is not.

California Prison System: End Of Federal Oversight Not Certain, Interview Suggests

SACRAMENTO, Calif. -- The court-appointed receiver overseeing California's prison health care system said Friday the state must keep its promise to spend more than $2 billion for new medical facilities before the federal courts can end an oversight role that has lasted six years.

California committed to spending $750 million to upgrade existing medical facilities, building a new $906 million medical center and converting juvenile lockups at a cost of $817 million. So far, only the new medical center in Stockton is being built.

Receiver J. Clark Kelso told The Associated Press that the state must begin all the upgrades before it should be allowed to retake control of a prison medical system once deemed so poor that it was found to have violated inmates' constitutional rights. They are his first public comments since a federal judge last week told officials to begin preparing for an end to the receivership.

"That leaves a court order that the state is now out of compliance with," Kelso said during the 75-minute interview. "The courts have been promised construction for the last half-decade. Somehow those promises don't get kept."

California officials are analyzing the need for new medical facilities in light of a state law that took effect last year that is sending lower-level criminals to county jails instead of state prisons. Federal judges have ordered the state to reduce its prison population by 33,000 inmates over two years to improve the treatment of mentally and physically ill inmates, a decision that has been upheld by the U.S. Supreme Court.

At its height in 2006, California's inmate population was more than 162,000.

Kelso said the medical center that is under construction in Stockton and the $750 million in upgrades are needed even if the state has fewer inmates. Conversion of the juvenile lockups was to have included new housing and treatment facilities for sick and mentally ill inmates.

Kelso has been negotiating with officials from the state Department of Corrections and Rehabilitation and attorneys representing inmates after a federal judge issued a notice saying it was time to begin ending the federal receivership. Court oversight of medical care in the nation's largest state prison system has led to improvements in inmate health care that have cost California taxpayers billions of dollars.

"We'll just see if the parties can't find a middle ground for agreement," Kelso said.

The pace of those negotiations will determine how quickly the state can retake control of its prison health care operations, he said.

Corrections Secretary Matthew Cate said he wanted to see the receivership end as early as this summer, although he also said it would be appropriate for the courts to maintain some type of oversight role to ensure that inmate care does not deteriorate.

"I think the sooner we return day-to-day operations to the state, the better," Cate told the AP in an interview earlier this week. "We need to work out the construction issues, obviously, and I know that Clark is also concerned about making sure there's a strong structure in place to maintain the strides we've made. But if we can work those issues out, I'd love to see it be this summer."

Kelso said the state also should create a quasi-independent medical bureaucracy within the corrections department to make sure the state doesn't backslide because of budget cuts or a lack of interest.

"A lot of that has to do with budget independence and the independence of the head of prison health care really to control his or her budget," Kelso said. "They can't just get lost in the big haze that is the corrections budget."

He said the corrections department traditionally has focused on keeping inmates safely locked up, with a lesser emphasis on the well-being of those prisoners, and it is unclear if that culture has changed.

Citing inmate overcrowding as the leading cause, the federal courts previously found that medical care for California prisoners was so poor that an average of one inmate a week was dying of neglect or malpractice. It ordered the prison population reduced, prompting the department to send layoff notices this week to 545 employees because fewer workers are needed as the number of inmates declines.

In the notice he filed last week, U.S. District Court Judge Thelton Henderson said conditions had improved enough to consider ending the receivership. He said most of the goals of the federal oversight had been met.

The San Francisco-based judge ordered Kelso, state officials and inmates' attorneys to report by April 30 on when the receivership should end and whether it should continue some role in ensuring that conditions remained constitutional.

"I think this all depends much more on the state's progress than on mine," Kelso said. "Frankly, if the construction had been done as promised, I'd be a hell of a lot closer."

Samsung Stratosphere Vs. iPhone 4S (ContributorNetwork)

When a wireless customer wants a "top of the line" phone these days, they have the benefit of a choice; do you want an iPhone or a Samsung's latest Galaxy device, which is currently the Stratosphere?

Both the iPhone 4S and the Samsung Stratosphere have the most up to date hardware and each have their own class of innovative apps and software. The most obvious physical difference is that the Stratosphere has a slide out QWERTY keyboard. In processing power the two phones are matched well, with the Apple's 800MHz dual-core processor running iOS 5.0.1 nearly as fast as the Stratosphere's 1GHz "Hummingbird" processor runs Android.

In the hardware department Apple's primary advantage comes in the form of an 8.0MP rear-facing camera capable of capturing HD video in 1080P and a 0.3MP front-facing camera that is useful when combined with the FaceTime application to enjoy video calling to any FaceTime enabled device over WiFi . Popular applications such as Instagram make full use of the iPhone 4S' superb camera, and at the moment is only available on Apple devices.

The Stratosphere may only have a 5.0MP camera, but in addition to the slide out QWERTY keyboard also features a WVGA Super AMOLED screen that reigns supreme over all smartphone displays currently on the market. The screen is covered by Gorilla Glass, which is highly resistant to scratches and cracking. If you consume more media through your display than you create with your camera, the AMOLED screen is definitely a feature to look into.

On the software side Apple runs the show with its new SIRI voice activated interface, probably the most interesting new smartphone feature of 2011. Users can complete a variety of actions by merely having a normal sounding conversation with their device. A question like "What will the weather be like today?" will get a response like "Cloudy with a high of 63 degrees". SIRI needs Internet access to run, but has the ability to learn from prior exchanges and adapts to the user's voice over time. The Stratosphere has its own unique software in a built-in Kindle E-reader and an HTML browser that does support flash content. It also has the ability to become a media hub or Mobile hotspot , supporting up to 8 devices on a 4G connection.

Both phones offer 8 hours of talk time and approximately 200 hours of standby, and the iPhone weighs in at 14 grams lighter than the Startosphere . The 4S comes in three different sizes, a 16GB, 32GB and 64GB (each increasing substantially in price) while the Samsung comes with 4GB onboard memory and a micro SD slot that is expandable to up to 32GB. The kicker for the Samsung Stratosphere may just be the price; retailing at $409.00, the normal price from Verizon with a 2-year contract is $149.99. There is currently an online discount that drops the price down to $99.99 with a 2-year contract. The 32GB version of the iPhone retails for $749.99 and can be had for $299.99 with a 2-year contract with Verizon .

Several dead after landslide hits Papua New Guinea (AP)

PORT MORESBY, Papua New Guinea ? Rescuers were pulling bodies from the debris of a landslide that struck mountainous central Papua New Guinea, a disaster official said Wednesday, with reports saying as many as 60 people were dead or missing.

The full extent of the damage to villages hit by Tuesday's landslide was not immediately known, said Martin Mose, the director of the South Pacific island nation's National Disaster Center.

"I just received reports that several bodies have been recovered," Mose told The Associated Press. He said he was waiting for officials at the scene ? near the town of Mendi ? to provide him with the exact number.

The National newspaper reported that 40 bodies had been recovered and 20 people were still missing.

Local lawmaker Francis Potape told Radio Australia's indigenous language service that the landslide completely covered two villages while people slept.

"There are people buried underneath and a number of them are, from what I have heard, children," The National quoted Potape as saying.

Reports said the destruction extended more than one mile (two kilometers), leaving roads to villages cut off.

Three National Disaster Center officials were being flown by helicopter to Mendi on Wednesday to join police at the disaster site.

The Post Courier newspaper reported that Prime Minister Peter O'Neill would fly to the state later Wednesday.

CSX posts higher 4Q profit and revenue (AP)

JACKSONVILLE, Fla. ? Freight railroad operator CSX Corp. said Monday that fourth-quarter profit rose 6 percent as higher rates offset a decline in the volume of goods it shipped.

The company also announced it had replaced its chief operating officer.

CSX shares fell in after-hours trading.

CSX said Chief Financial Officer Oscar Munoz would become chief operating officer, replacing David A. Brown, who is "no longer with the company." CSX said the change was unrelated to the company's business or financial performance.

Fredrik J. Eliasson, a 16-year CSX veteran, will take Munoz's spot as CFO. He was vice president of sales and marketing for CSX's chemicals and fertilizer business.

CSX net income in the quarter ended Dec. 30 rose to $457 million, or 43 cents per share, from $430 million, or 38 cents per share, a year earlier.

Analysts expected 44 cents per share, according to a survey by research firm FactSet.

The railroad shipped less coal, chemicals and agricultural products than it did a year ago. Overall volume was down 4 percent. CSX said it shipped less coal because utilities needed less of it to generate electricity. Some utilities are using more natural gas to run generators, because its price is close to a 10-year low.

CSX carried more cars and automotive components in the quarter, as North American production picked up from a year ago. Volume of some construction materials ? such as crushed stone and sand ? was also higher, helped by mild winter weather that extended the building season in many parts of the country.

Revenue per shipping unit jumped 9 percent ? led by double-digit increases for hauling coal and autos. That helped the company boost revenue to $2.95 billion, compared with $2.82 billion a year earlier. Analysts expected $2.99 billion.

Economists follow the performance of railroads as one indicator of the strength of the broader economy. That's because railroads haul a wide range of things, from consumer goods to cars and commodities like coal and grain.

The report wasn't as ringing as last week's numbers from bigger rival Union Pacific Corp., which said fourth-quarter net income jumped 24 percent. UP raised prices and hauled more freight during the quarter.

CSX officials planned to discuss the results in a conference call with analysts on Tuesday.

The shares fell 13 cents to close at $22.69 before the results were posted. In after-hours trading, they dropped 62 cents, or 2.7 percent, to $22.07.

Marine to serve no jail time in Iraqi killings (AP)

CAMP PENDLETON, Calif. ? The lone Marine to face sentencing for the killing of two dozen unarmed Iraqis in one of the Iraq War's defining moments walked away with no jail time Tuesday after defending his squad's storming of the homes of Haditha as a necessary act "to keep the rest of my Marines alive."

Staff Sgt. Frank Wuterich's sentence ends a six-year prosecution for the 2005 attack that failed to win any manslaughter convictions. Eight Marines were initially charged; one was acquitted and six others had their cases dropped.

Wuterich, who admitted ordering his squad to "shoot first, ask questions later" after a roadside bomb killed a fellow Marine, ended his manslaughter trial by pleading guilty on Monday to a single count of negligent dereliction of duty.

The deal that dropped nine counts of manslaughter sparked outrage in the besieged Iraqi town and claims that the U.S. didn't hold the military accountable.

"I was expecting that the American judiciary would sentence this person to life in prison and that he would appear and confess in front of the whole world that he committed this crime, so that America could show itself as democratic and fair," said survivor Awis Fahmi Hussein, showing his scars from a bullet wound to the back.

Military judge Lt. Col. David Jones initially recommended the maximum sentence of three months for Wuterich, saying: "It's difficult for the court to fathom negligent dereliction of duty worse than the facts in this case."

But after opening an envelope to look at the terms of the plea agreement as is procedure in military court, Jones announced the deal prevented any jail time for the Marine.

"That's very good for you obviously," Jones said tersely to Wuterich.

Jones did recommend that the sergeant's rank be reduced to private, but decided not to cut two-thirds of his pay because the divorced father has sole custody of his three daughters. The rank reduction has to be approved by a Marine general, who already signed off on the plea deal.

Wuterich read a statement apologizing to the victims' families and said he never fired on or intended to harm innocent women and children. But he said his plea shouldn't be seen as a statement that he believes his squad dishonored their country.

"When my Marines and I cleared those houses that day, I responded to what I perceived as a threat and my intention was to eliminate that threat in order to keep the rest of my Marines alive," he said. "So when I told my team to shoot first and ask questions later, the intent wasn't that they would shoot civilians, it was that they would not hesitate in the face of the enemy."

"The truth is I never fired my weapon at any women or children that day," Wuterich told Jones.

The contention by Wuterich, 31, of Meriden, Conn., contradicts prosecutors and counters testimony from a former squad mate who said he joined Wuterich in firing in a dark back bedroom where a woman and children were killed.

Prosecutors argued that Wuterich's knee-jerk reaction of sending the squad to assault nearby homes without positively identifying a threat went against his training and caused needless deaths of 10 women and children.

"That is a horrific result from that derelict order of shoot first, ask questions later," said Lt. Col. Sean Sullivan.

Defense attorney Neal Puckett said Wuterich has been falsely labeled a killer who carried out a massacre in Iraq and insisted he only intended to protect his Marines in an "honorable and noble" act.

"The appropriate punishment in this case, your honor, is no punishment," Puckett said.

Wuterich directly addressed family members of the Iraqi victims, saying there were no words to ease their pain.

"I wish to assure you that on that day, it was never my intention to harm you or your families. I know that you are the real victims of Nov. 19, 2005," he said.

Wuterich, who hugged his parents after he spoke, declined comment on Jones' decision. His attorneys, Neal Puckett and Haytham Faraj, said in a statement: "We believe justice prevailed for Staff Sgt. Wuterich and in turn, he wishes it was within his power to impart the same measure of justice to the families of the victims of Haditha."

Military prosecutors worked for more than six years to bring Wuterich to trial on manslaughter charges that could have sent him away to prison for life. But only weeks after the long-awaited trial started, they offered Wuterich the deal that stopped the proceedings.

It was a stunning outcome for the last defendant in the case once compared with the My Lai massacre in Vietnam.

The Haditha attack is considered among the war's defining moments, further tainting America's reputation when it was already at a low point after the release of photos of prisoner abuse by U.S. soldiers at Abu Ghraib prison.

During the trial before a jury of combat Marines who served in Iraq, prosecutors argued Wuterich lost control after seeing his friend blown apart by the bomb and led his men on a rampage, blasting their way in with gunfire and grenades. Among the dead was a man in a wheelchair.

Faraj said the deal was reached last week when the government recognized its case was falling apart with contradictory testimony from witnesses who had lied to investigators. Many of the squad members had their cases dropped in exchange for testifying. Prosecutors have declined to comment.

Wuterich was also seen as taking the fall for senior leaders and more seasoned combat veterans in his squad, analysts said. It was his first time in combat.

Brian Rooney, an attorney who represented a former defendant, said cases like Haditha are difficult to prosecute because a military jury is unlikely to question decisions made in combat unless wrongdoing is clear-cut and egregious, like rape.

"If it's a gray area, fog-of-war, you can't put yourself in a Marine's situation where he's legitimately trying to do the best he can," said Rooney, who represented Lt. Col. Jeffrey Chessani, the highest-ranking Marine charged in the case. "

Many of his squad mates testified that they do not believe to this day that they did anything wrong because they feared insurgents were inside hiding.

Wuterich plans to leave the Marine Corps and start a new career in informational technology. His lawyers said they plan to petition for clemency.

Republican hopefuls take fight to Florida (Reuters)

COLUMBIA, South Carolina (Reuters) ? After a bruising clash in South Carolina, Republican presidential frontrunners Mitt Romney and Newt Gingrich will take their battle to a bigger stage when the campaign moves to Florida on Sunday.

Gingrich, a former U.S. House of Representatives speaker, thrashed Romney in the South Carolina primary on Saturday, suggesting the race for their party's nomination and the right to face President Barack Obama in November may last months more.

The largest of the early voting states by far, Florida presents logistical and financial challenges that appear to give an advantage to Romney's well funded campaign machine.

But Gingrich has momentum after coming from behind in South Carolina to win around 40 percent of the vote, followed by Romney with 28 percent. Rick Santorum, a former U.S. senator, was in third with 17 percent and U.S. congressman Ron Paul in fourth with 13 percent.

"We proved here in South Carolina that people ... with the right ideas beats big money," Gingrich told supporters after his victory in the conservative state.

After strong performances in a series of debates, Gingrich was seen by South Carolina voters as the most likely Republican to beat Obama, a Democrat, in the November 6 election.

They also rejected millionaire former businessman Romney's pitch that he is the best bet to fix a broken U.S. economy and win the White House.

Romney and Gingrich, who have attacked each other mercilessly in a series of negative television ads since December, face off in a debate in Tampa, Florida, on Monday night.

ROMNEY TAX SOLUTION?

Romney has stumbled over questions about his personal finances in recent debates and acknowledged last week that he only pays a 15 percent tax rate, much lower than that of most working Americans.

The former Massachusetts governor has so far resisted calls from rivals, and even ally New Jersey Governor Chris Christie, to release his tax returns.

To try to put the tax return controversy behind him, the Romney campaign has a plan to settle the issue next week, a Republican official said.

That is part of a strategy to be more aggressive against Gingrich, a formidable debater who nevertheless has personal and professional baggage that the Romney team could exploit. Romney accuses Gingrich of being a Washington insider.

"The choice within our party has also come into stark focus. President Obama has no experience running a business and no experience running a state. Our party can't be lead to victory by someone who also has never run a business and never run a state," Romney said on Saturday.

Romney saw his aura of inevitability erode in South Carolina after leading opinion polls by 10 percentage points a week ago.

In Florida, he leads Gingrich by 40.5 percent to 22 percent, according to a poll of polls by RealClearPolitics.com. Santorum, a social conservative who is from Pennsylvania, is third with 15 percent.

Campaigns must spend at least $1 million each week to reach voters in the sprawling southern state, according to local political officials. Romney's allies have already spent $5 million, mostly on ads attacking Gingrich. No other candidate has a significant presence in the state.

Romney to release his tax returns on Tuesday

(AP) ? Republican presidential candidate Mitt Romney said Sunday that he will release his 2010 tax returns and 2011 estimates on Tuesday, acknowledging it was a mistake for his campaign not to have done so earlier.

Stung by a loss to Newt Gingrich in Saturday's South Carolina primary, the former Massachusetts governor and venture capitalist said it was "not a good week for me" and he cited all the time he had spent talking about his tax returns as his rivals pressed him to make them public.

After months of resistance, Romney had said last week that he would release tax information for 2011, but not until April, close to the tax filing deadline. That also was seen as a time, before the South Carolina race rattled his front-runner status, when the GOP nomination might have been decided.

"I think we just made a mistake in holding off as long as we did. It just was a distraction. We want to get back to the real issues of the campaign: leadership, character, a vision for America, how to get jobs again in America and how to rein in the excessive scale of the federal government," Romney told "Fox News Sunday."

Romney disclosed on Tuesday that, despite his wealth of hundreds of millions of dollars, he has been paying in the neighborhood of 15 percent, far below the top maximum income tax rate of 35 percent, because his income "comes overwhelmingly from investments made in the past."

"Given all the attention that's been focused on tax returns, given the distraction that I think they became in these last couple of weeks," Romney said in the broadcast interview that he would release his 2010 returns and estimates for his 2011 returns at the same time "so there's not a second release down the road."

"We'll be putting our returns on the Internet, people can look through them," Romney said. "It will provide, I think, plenty of information for people to understand that the sources of my income are exactly as described in the financial disclosure statements we put out a couple of months ago.

During 2010 and the first nine months of 2011, the Romney family had at least $9.6 million in income, according to a financial disclosure form submitted in August.

Further focusing attention on his wealth was Romney's offhand remark to reporters that his income from paid speeches amounted to "not very much" money. In the August disclosure statement, he reported being paid $373,327.62 for such appearances for the 12 months ending last February. That sum alone would him in the top 1 percent of U.S. taxpayers.

In addition, Romney owns investments worth between $7 million and $32 million in offshore-based holdings, which are often used legitimately by private equity firms to attract foreign investors. Such offshore accounts also can enable wealthy investors to defer paying U.S. taxes on some assets, according to tax experts.

An Associated Press examination of Romney's financial records identified at least six funds set up in the Cayman Islands, a small Caribbean island chain that has long been used as a base for international investments because of low tax rates and financial secrecy. Romney has acknowledged that some of his investments are based in the Caymans, but he has not identified all of the specific accounts and the amounts based there. There is no indication Romney uses the accounts to dodge any U.S. tax obligations.

"Cayman Islands account so-to-speak is apparently an investment that was made in an entity that invests in the United States, the taxes paid on that are full U.S. taxes," Romney said.

The Caymans have often been associated with individuals and corporations seeking to avoid paying U.S. taxes. It is legal for U.S. residents to own investment accounts that are set up there, if they file the proper forms with the Internal Revenue Service and pay the appropriate taxes.

"I know people will try and find something," Romney said, adding, "We pay full, fair taxes, and you'll see it's a pretty substantial amount."

An Android tablet designed for Chinese officials without special features inexplicably costs $1,600

Would you buy a $1,600?Android tablet that doesn't have any special features compared to other slates half its price? A relatively unknown Chinese manufacturer seems to think people would, and released a tablet called the RedPad ? a?Honeycomb device specifically meant for?China's government officials, that costs almost two grand.

The 9.7" RedPad?is a pretty standard Android?tablet fare, with 1GB of RAM, and 16GB of storage, which is usually the lowest capacity found in mid-range slates. For $2,000, you'd think buyers will get a top-of-the-line device or at least a few extras. But the only bonus they will get is a rather shoddy looking leather case, and an inscription of China's "Serve the People" slogan at the back of the tablet. The total cost for manufacturing each device is $480, so why it's priced at $1,600 is beyond us. An?interview with the company spokesperson, Xianri Liu, reveals RedPad's somewhat twisted reasoning for that price point: the company believes people think expensive things are good. Therefore, RedPad must be good.

He also argues that RedPad comes with a bunch of apps including tablet versions of periodicals, and a state-sanctioned Chinese version of?Twitter. Installing those kinds of apps on the?iPad, he says, will cost as much as $1,600 in a year. A device of that price point targeted toward?politicians will almost certainly cause a stir not only within China, but all over the internet.

Liu says the company plans to release RedPad to market, and compete with?Apple's iPad?? a feat that will be extremely hard to accomplish when the tablet costs that much.

Home sales gain points to a nascent recovery

Sales of previously owned homes rose to an 11-month high in December and the supply of properties on the market dropped to a near 7-year low, an industry group said on Friday, pointing to a nascent recovery in the housing market.

The National Association of Realtors said existing home sales increased 5 percent month over month to an annual rate of 4.61 million units. November's sales pace was revised down to a 4.39 million-unit pace, previously reported as a 4.42 million-unit rate.

Economists polled by Reuters had expected sales to rise to a 4.65 million-unit sales pace in December. Sales last month were up 3.6 percent from a year ago.

For the whole of 2011 sales showed a gain over 2010 totals. A total of 4.26 million homes were sold last year, up 1.7 percent from the prior year.

A?third straight month of gains in sales added to hopes that a tentative recovery in the housing market is starting take shape, but progress will be painfully slow given a glut of unsold properties that is weighing down on prices.

Ivy Zelman, CEO of Zelman & Associates, a housing-research firm, appeared on CNBC earlier to explain why she believes the housing market has bottomed and is the very early stages of recovery:

However, Jacob Oubina, senior U.S. economist for RBC Capital Markets in New York, reckons the ?foreclosure overhang? will continue to weigh on housing for some time.

?If you look at the report the supply fell, but what that doesn't take into account is the shadow overhang, the distressed side of the market, people that are basically delinquent on their mortgages and haven't gone through foreclosure yet,? he said.

?That pipeline is worth seven million units, and represents about 20 months of supply. The distressed is still a huge problem. When you look at home prices overall in the U.S. I think they're still going to decline modestly in 2012,? he added.

NEW YORK ? Ryan Braun's appeal of his positive drug test began Thursday before baseball arbitrator Shyam Das.

The start of the National League MVP's appeal, first reported by the New York Daily News, was confirmed by a person familiar with the session who spoke on condition of anonymity because the proceeding was not to be made public.

Calls to Braun's agent, Nez Balelo, and Major League Baseball spokesman Pat Courtney were not returned.

When the positive drug test was first reported by ESPN.com last month, Braun had a spokesman issue a statement saying there were circumstances supporting "Ryan's complete innocence."

Under the joint drug agreement between baseball teams and the players' association, Braun will have to prove "the presence of a prohibited substance in his urine was not due to his fault or negligence."

As Braun tries to avoid a 50-game suspension, the burden is a heavy one to overcome. A baseball arbitrator has never ordered a suspension overturned following a grievance hearing.

The person did not know whether the hearing had concluded or whether it would extend into at least one more session. Typically in grievances, after the hearing the sides may submit written final arguments before the arbitrator rules.

MLB has not confirmed the positive test. Baseball's drug agreement says first positive tests are not made public until after the appeals process has been completed.

Technically, the arbitration is before a three-person panel that also includes a representative of management and the union. The independent member, Das, is the decisive vote in nearly all cases.

Braun is to receive his MVP Award on Saturday at the annual dinner of the New York chapter of the Baseball Writers' Association of America. While he is expected to speak to the crowd from the dais in a hotel ballroom, he is not expected to take questions from reporters.

Braun has known about since the positive test since late October, people familiar with the appeals process said last month. If suspended, Braun wouldn't be eligible to play for the NL Central champions until May 31 at Dodger Stadium, barring any postponements. He would miss the first 57 days of the major league season, losing about $1.87 million of his $6 million salary.

The 28-year-old the 2007 NL Rookie of the Year, hit .312 with 33 homers and 111 RBIs last season and led Milwaukee to the NL championship series, where the Brewers lost to the eventual World Series champion St. Louis Cardinals.

Latest homeless victim feared he was being stalked (AP)

SANTA ANA, Calif. ? The latest homeless victim of a suspected serial killer filed a police report the day before he died, saying he feared he was being stalked.

It was one of nearly 600 leads and tips that officers received, but police didn't have a chance to follow up.

"It is unfortunate that we didn't get to him before the suspect did," Anaheim Police Chief John Welter said.

Itzcoatl Ocampo was arrested Friday night when witnesses chased him down after a man was stabbed to death outside a fast-food restaurant in Anaheim, about 26 miles southeast of Los Angeles, authorities said. He was caught with blood on his hands and face, authorities say.

The Iraq War veteran was charged Tuesday with four counts of murder and special allegations of multiple murders and lying in wait and use of a deadly weapon. Three victims were stabbed more than 40 times each with a single-edged blade at least 7-inches long.

Ocampo was due to appear in court on Wednesday, but his attorney said his arraignment would likely be postponed since he was not allowed inside the jail to speak with his client over the weekend and has met with him only briefly.

Defense attorney Randall Longwith declined to comment on the allegations. He said Ocampo is being held in a mental ward.

"I walked in, he was curled up in a blanket," Longwith said. "He looked like a wet puppy dog."

Ocampo selected the last victim, 64-year-old John Berry, after he was featured in a Los Angeles Times story about the killing spree, prosecutors said.

"He was a monster," Orange County District Attorney Tony Rackauckas said at a news conference. "He was a terrible threat, particularly to the homeless people in our community."

Ocampo would stalk each of his victims, then stab them repeatedly with a knife that could cut through bone, authorities said.

Authorities declined to say whether they had identified a motive. Rackauckas said he had no indication that Ocampo was mentally ill.

Ocampo's family said the 23-year-old was a troubled man after he returned from Iraq in 2008.

If convicted, Ocampo faces a minimum sentence of life in prison without parole. Authorities have not decided whether to seek the death penalty.

The killing spree began in December, prompting police and advocates to fan out across the county, which is known as the home to Disneyland and multimillion-dollar beachfront homes, to urge the homeless to sleep in groups or in one of two wintertime shelters.

Ocampo's arrest was the latest violent crime involving a veteran. This month, an Iraq War veteran fatally shot a ranger at Mount Rainier National Park and died later as he fled police across the mountain's snow-covered slopes.

Veterans Affairs officials say such high-profile violence can paint an inaccurate picture of returning veterans. The cases, however, raise the issue of veterans having a difficult time adjusting back into civilian life.

To help, the VA created a program to assist veterans in readjusting to their lives and avoid repeated brushes with the law. "We've seen over and over again that once they access those services, we can help them," VA spokesman Josh Taylor said.

A neighbor who is a Vietnam veteran and Ocampo's father both tried to push him to get treatment at a VA hospital, but he refused. His father, Refugio Ocampo, said, his son came back from his deployment a changed man.

He said his son expressed disillusionment and became ever darker as he struggled to find his way.

After Ocampo was discharged in 2010 and returned home, his parents separated. The same month, one of his friends, a corporal, was killed during combat in Afghanistan. His brother said Ocampo visited his friend's grave twice a week.

Like the men Ocampo is accused of preying on, his father is homeless. His father lost his job and ended up living under a bridge before finding shelter in the cab of a broken-down big-rig he is helping to repair.

Days before his arrest, Ocampo visited his father, warning him of the danger of being homeless. He showed him a picture of one of the slain men, his father said.

"He was very worried about me," his father said. "I told him, `Don't worry. I'm a survivor. Nothing will happen to me.'"

As fear spread through the homeless community, police last week set up road blockades to seek help from members of the public in tracking down a suspect. Ocampo, who appeared to relish the media spotlight, passed through the checkpoints twice but did not draw attention to himself, Rackauckas said.

In addition to Berry, James Patrick McGillivray, 53, was killed near a shopping center in Placentia on Dec. 20. The body of Lloyd Middaugh, 42, was found near a riverbed trail in Anaheim on Dec. 28. The third victim, Paulus Smit, 57, was stabbed to death outside a library in Yorba Linda on Dec. 30.

Tornadoes touch down in Indiana, Kentucky and Mississippi (Reuters)

(Reuters) ? Tornadoes struck parts of Mississippi, Indiana and Kentucky on Tuesday, including one that hit a home in Mississippi and injured at least one person, meteorologists said.

The Indiana and Kentucky twisters knocked out power lines, downed trees and caused property damage, while a Sheriff's Department dispatcher said the Mississippi tornado struck a home in south Marion County, and a person who was inside suffered a possible broken arm.

Tornadoes are unusual for this part of the year in Indiana and neighboring Kentucky, although twisters occasionally hit Mississippi during the current season, said Dan Pydynowski, senior meteorologist at AccuWeather.com, whose company provides forecasting services.

A cold front combined with a warm and humid air mass contributed to the latest twisters, but those conditions were dissipating, he said.

"The threat's pretty much come to an end everywhere, so I don't think there's any more tornadic activity to worry about anywhere at this point," Pydynowski said.

In the area of Louisville, Kentucky, a twister knocked down trees and power lines along roadways, the National Weather Service said. To the north in Clark County, Indiana, a twister touched down in the parking lot of a Wal-Mart, the Weather Service added. When the twister moved, a vehicle was turned over on nearby Interstate 65, the agency said.

At Madison Municipal Airport in southeast Indiana, a twister also damaged a Beechcraft King Air when it moved the small plane and broke its nose gear, the Weather Service said.

Wisest Future for Jon Huntsman's Super PAC (ContributorNetwork)

COMMENTARY | Jon Huntsman has decided to suspend his candidacy for the Republican nomination, according to The Ticket. As a political consultant, I see Huntsman's super PAC as a wild card moving forward. He has a few options as to what to do with the money and could use it to make the future more interesting for Mitt Romney or for himself.

The Washington Post has pointed out the ruling that allows candidates without a political post taking over their own super PAC. Since Huntsman is not serving in government, he would be able to take over the money in the account or could give more direct influence on how the money can be used in the future.

Of course, there is the chance Huntsman's super PAC is dry. I would be surprised by this, but it is a potential reason why he would drop out of the race. My guess, though, is a realization coming to the candidate and his staff that their ability to raise funds could not match the speed in which it would need to be spent to improve his standings in the field.

There are two intelligent uses for Huntsman's super PAC in the near future. First, I could see the candidate using some of the money to support Romney. This would take a step in helping Romney knock the other candidates down a step and could open a door for Huntsman in the future. If Romney wins the election in November, a cabinet position might be out of the question for a particular former candidate who helped out.

The second idea would be to hold onto the money for a future run. He could spend money to keep him in the public eye or he might bank the money and watch it grow until the next time he might have a chance at running. Either way, Huntsman would have a leg up on other candidates in the future since his base account money should be ahead of theirs. This could set up a potential early onslaught by the former ambassador.

Sarkozy calls for courage, calm in face of crisis

(AP) ? French President Nicolas Sarkozy says France must have the courage and calmness to make difficult decisions to overcome the financial crisis, in his first public appearance since the country's credit rating was downgraded.

But Sarkozy avoided any mention Sunday of the loss of France's prized AAA rating in a Standard & Poor's review two days earlier.

Instead he issued a rallying call, saying that a united France committed to reform would make it through.

France chooses a new president this spring, and Sarkozy was already behind in the polls before the downgrade.

The loss of the AAA rating was a severe blow to France's self-image and is expected to hurt Sarkozy's standing even further.

Some people use a mobile phone only, while others piece together a variety of services: a landline for reliability, a smartphone for mobility, Google Voice (4 stars, Editors' Choice) for free calls to other Google Voice users or any number in the U.S., and so on. What Obihai's OBi110 does, unlike many other VoIP devices, is bridge together all those services. What it doesn't do is offer its own complete service. You have to bring your own service to OBi, whereas other VoIP device manufacturers, such as Vonage or YMax magicJack, typically charge a monthly or yearly fee for the service end. For some, this makes the OBi110 very attractive, because Google Voice is free for calls to U.S. numbers.

The OBi110 is also highly customizable. Connect it to your router, and you can configure where and how you make phone calls, using Google Voice, for example, to receive free calls on a traditional phone handset, or calling out from a mobile app on your iPhone or Android phone, routing through OBi or Google Voice so that your mobile service provider doesn't charge you for the call. The catch is, it takes a good amount of time, concentration, and online tutorial videos to set it all up. But the payoff might be worth it.

Admittedly, the OBi110 is not for everyone. It's best suited, in my opinion, to tinkerers, DIY enthusiasts, self-learners, and really anyone who likes having granular control of technology. OBi110 gives you a lot of control over how calls route across several services and devices, but you do have to work for it.

If instead you're in the market for a VoIP service that works with a traditional handset phone and is much more plug-and-play ready, we recommend NetTALK DUO ($50 street, 4 stars), our Editors' Choice for consumer VoIP, which is inexpensive, reliable, and very easy to set up. Another good but expensive option is the Ooma Telo ($250 direct, 3 stars), which is more complex than NetTALK but offers some of the same call routing/bridging benefits of the OBi110, including support for Google Voice. Integration with Google Voice is a huge selling point for both Ooma and Obihai because Google has made the service totally free for calls within the U.S. through 2012. As sophisticated and stylish as the Ooma Telo is, the high upfront cost is tough to recoup, even with free U.S. calls for the rest of the year. For 50 bucks, the OBi110 is pretty cheap, comparatively.

Set Up and Features
Setting up the OBi110 took me a long time. In working with other VoIP devices that connect to phone handsets, I've learned that a thorough and illustrative instruction guide?one that helps you do your own troubleshooting?is indispensible. The one I received wasn't very thorough, although an Obihai company representative said a new set of instructions is in the works. Video tutorials help as well, and you'll find plenty of them for OBi110 with a Web search.

The white and gray plastic OBi110, measuring 1.2 by 4.2 by 4.5 inches (HWD) has two telephone jacks, an Ethernet port, and one power connection point on the back. The Ethernet port connects to a router. The power obviously goes to an electrical outlet. One of the phone lines lets you connect a telephone handset, while the other?which is optional to use?can connect to a landline telephone wall jack for those who want to keep an existing landline but route it through the OBi device.

During setup, you should connect all the lines in the order specified in the instructions, saving the power for last. Once all the wires are hooked up, indicator lights on the top of the OBi110 will hopefully give you the A-OK to proceed.

Next, you'll need to surf over to OBiTalk.com to create an OBi account, register your device, and get a special dialing code that allows your OBi110 and phone to make contact with OBi's servers. Several of these steps were not clear to me, but like I said, the company is revising its setup instructions.

'Consequences': Iran warns Gulf countries not to replace its oil

TEHRAN - An Iranian pro-reform newspaper says the country's OPEC governor has warned the country's Arab neighbors that Tehran will view any increase in crude production to counterbalance a potential embargo on Iranian oil as an unfriendly act.

A Sunday report by Shargh daily quotes Mohammad Ali Khatibi as saying that Arab nations will be an "accomplice in the consequences," if they raise output to offset any potential loss of Iranian crude exports due to an embargo.


New U.S. sanctions against Iran approved last month target the country's central bank and, by extension, its ability to sell petroleum abroad. The U.S. has delayed implementing the sanctions for at least six months. The EU is also contemplating an embargo.

Iran is OPEC's second-largest oil producer after Saudi Arabia with output of about 3.5 million barrels per day. It is facing trade hurdles over its nuclear program, which the United States and its allies say is aimed at building bombs.

Iran says it needs nuclear technology to generate electricity.

EU countries have proposed "grace periods" on existing contracts of one to 12 months to allow companies to find alternative suppliers before implementing an embargo.

Iran has threatened to block the vital oil shipping route of the Strait of Hormuz in the Gulf if sanctions imposed on its oil exports.
